The state stopped imposing its estate tax for deaths on or after January 1, 2018, but the transfer inheritance tax remains: siblings and children-in-law pay 11 to 16 percent above a $25,000 exemption, unrelated heirs pay 15 percent on the first $700,000 and 16 percent above it, and the return and payment are due eight months after death. When a probate inventory is required, the statute calls for appraisal by two discreet and impartial persons, and we document values to fit that framework.

  • My daughter had purchased a very collectible 2003 Mustang Cobra terminator just 3 months before her accident with 50,000 miles on it, for 30,000 dollars. We were experiencing some very heavy rains and she hydroplaned and smashed into a guard rail and totaled her car. The insurance company offered her $18,000, but we told them that was an insult to this car. We kept going round and round with them but they were not budging. New Jersey FAQ

Can New Jersey require an expert appraisal for inheritance tax?

Yes. Under the Division of Taxation's regulations, the Director may require that the value of any tangible asset subject to the transfer inheritance tax be supported by an appraisal from a broker, dealer, jobber, or another person with expert knowledge of that property's market value. Executors who file with a documented appraisal of the contents, vehicles, or collection already attached have answered that demand before it is made.

Which New Jersey death tax still applies?

The transfer inheritance tax. New Jersey no longer imposes an estate tax on anyone who died on or after January 1, 2018, but the inheritance tax remains, and for a resident decedent it can reach nearly every asset type, including vehicles and personal property. Class A beneficiaries (the closest relatives) owe nothing; Class C and Class D beneficiaries are taxed at 11 to 16 percent on the value they receive above their exemptions.
