Wisconsin uses no probate referee system, so the personal representative may engage any qualified appraiser, and Wisconsin imposes no estate or inheritance tax.
Presumptively, yes. Wis. Stat. § 767.61 presumes equal division of marital property, including firearms, though courts may deviate after weighing statutory factors, and assets are generally valued as of the divorce or final hearing. A documented fair market value appraisal of the collection keeps that division grounded in market evidence.
It shouldn't. Wis. Stat. § 865.20 lets the personal representative employ a qualified and disinterested appraiser for assets whose value is subject to reasonable doubt, and Wisconsin practice guidance warns against relying on shops or prospective buyers, whose numbers can be biased and can overlook collector or historical value. A disinterested appraisal also protects the representative when values must be equalized among beneficiaries.
Locate the ATF Form 4 before anything is moved. Wisconsin estate guidance stresses that federally registered items such as machine guns, short-barreled rifles and shotguns, and suppressors should stay put until the executor finds the registration paperwork, and ownership cannot pass until a new Form 4, the $200 tax stamp, and federal registration to the transferee are complete. Those constraints also shape the realistic market for such pieces.
