At fair market value as of the decedent's date of death, which in a supervised D.C. administration applies to every item of personal property in the inventory. We establish those retrospective values through comparable auction and private sale evidence for each work, documented so the figures survive review by the Register of Wills.
The inventory, including appraised personal property values, is generally filed on Probate Division Form 27 within three months after the personal representative is appointed. Estates with art collections should start the appraisal early in that window, since researching attributions and comparables for multiple works takes time.
Provenance files, condition reports, exhibition and publication history, and prior invoices or auction catalog entries, each of which measurably influences the value conclusion. For D.C. collectors, gallery purchase records and museum loan paperwork often resolve attribution questions that would otherwise widen the value range.
The artist. D.C. Code § 28-5102 makes a dealer who accepts fine art on consignment the artist's agent, with the work and its sale proceeds held as trust property, and § 28-5104 shields them from the dealer's creditors. For valuation work, that means consigned pieces hanging in a gallery are not the gallery's assets, a distinction that matters in bankruptcies, estates, and inventory appraisals.
