We select recent sales of similar works, adjust for artist, condition, provenance, and market timing, and reconcile them to a fair market value conclusion with the comparables cited in the report.
Yes. Rhode Island imposes a state estate tax, and under R.I. Gen. Laws Section 44-23-5 the tax administrator may independently appraise estate property if the filed statement appears erroneous or incomplete. A documented appraisal with cited comparables is the practical defense against a state-side revaluation.
Ninety days from the executor's or administrator's appointment, unless the probate court allows longer. The inventory must cover all tangible personal property, including art, with an appraisement at date-of-death fair market value under R.I. Gen. Laws Section 33-9-1.
It must be inventoried and appraised within 30 days of the guardian's appointment under R.I. Gen. Laws Section 33-15-19, by the guardian or a court-appointed disinterested person, as of the qualification date. For jointly owned pieces, the appraisal must state the basis for attributing all, part, or none of the value to the ward, a detail unique to guardianship work.
