Through the sales comparison approach: recent realized prices for similar works pulled from auction records and databases such as Sotheby's and Christie's archives, Invaluable, and MutualArt, adjusted for artist attribution, size, medium, condition, and provenance. The report documents each adjustment so the reasoning can be followed.
It depends on the assignment. Fair market value governs tax, estate, and equitable distribution work, while retail replacement value, typically higher, is for insurance scheduling, and marketable cash value nets out selling costs. Using an insurance figure for an estate or donation is one of the most common and expensive mistakes we correct.
Artwork is taxed at its date-of-death fair market value at rates set by relationship: 0% to a surviving spouse, 4.5% to children and other lineal heirs, 12% to siblings, and 15% to everyone else. The Pennsylvania inheritance tax return (REV-1500) is due nine months after death, and unlike the federal estate tax there is no large exemption, so even modest collections are taxed.
Value gets fixed quickly. Under Pa. R.Civ.P. 3205, any party in interest has ten days after the sheriff's notice to request an appraisal; otherwise the sheriff accepts the value stated in the claim. The requesting party advances the fee, the sheriff appraises the property, and that figure drives the ensuing proceedings, so timely, documented values matter in enforcement actions.
