N.D.C.C. § 30.1-18-07 authorizes the personal representative to employ a qualified and disinterested appraiser for any asset whose value is reasonably in doubt, and different appraisers may be used for different asset types. The appraiser's name and address must appear on the inventory next to the items they valued.
Fair market value as of the decedent's date of death. The inventory statute mandates that standard for every item, so insurance replacement figures or quick-sale estimates do not satisfy it. Artwork must be valued retrospectively to date-of-death market conditions, which is exactly what a properly dated appraisal delivers.
By identifying the appropriate marketplace first, then pulling realized results from auction records, dealer sales, and specialist databases rather than consumer price guides. Comparables are adjusted for attribution, condition, restoration, and provenance, and asking prices are treated as context only, since advertised numbers routinely differ from what works actually bring.
No. N.D.C.C. Section 57-02-27 forbids assessors from adopting auction or forced-sale prices as the criterion of value; each article must be valued by itself at what it is fairly worth in money. For business-held art that does reach the tax rolls, that statute points valuation toward open-market evidence rather than distressed hammer prices.
Household collections generally are not, but the exemption follows use, not the object. Personal property is a residual class covering everything outside the real property definition, and art held as gallery inventory or displayed as a business asset can be classified as taxable commercial property, with taxable valuation computed at 10 percent of an assessed value that is half of market value.
