How is antique artwork valued in Mississippi?

Through the sales comparison approach: recent sales of similar works drawn from auction archives and databases such as Sotheby's, Christie's, Invaluable, and MutualArt, adjusted for condition, restoration, size, and subject. Cost and income methods are secondary and apply only in narrow situations for antique art.

Is there a Mississippi estate tax on inherited art?

No. Mississippi imposes no state estate or inheritance tax, so inherited artwork faces only federal estate tax and only in estates above the federal exclusion. A date-of-death appraisal is still the right move because it documents the heirs' stepped-up basis and supports fair division.

Why is my insurance appraisal higher than fair market value?

Because insurance scheduling uses retail replacement value, the cost to replace the work through an appropriate gallery or dealer, while estate, tax, and divorce assignments use fair market value. Mixing the two definitions is a common source of error, so each report states which one it develops.

Can a Mississippi executor hire a specialist to value estate artwork?

Yes. Miss. Code 91-7-109 lets the executor or administrator employ a qualified, disinterested appraiser to establish fair market value as of the date of death for any asset whose value is reasonably in doubt, and different appraisers may be used for different asset types. The appraiser’s name and address must appear on the estate inventory.

Is artwork in a Mississippi home subject to property tax?

No. County guidance is explicit that personal effects and household furnishings are not taxed, so a painting hanging in a private residence stays off the rolls. Art owned by a business, such as gallery inventory or office decor, is different: it is Class III business personal property assessed at 15% of appraised true value.
