Because that date is set by the process rather than the parties, a divorce valuation should be built to that effective date, not to whenever the financials happened to be gathered.

Does Minnesota estate tax reach a closely held business?

Yes, once the taxable estate exceeds Minnesota's exclusion of about $3 million, with graduated rates up to 16% and no separate inheritance tax. A family business interest often represents most of that value, so a defensible fair market valuation is central to both planning and the eventual filing.

What evidence sits behind a credible business value?

Documented transactions in comparable companies from databases such as DealStats, BIZCOMPS, IBA Market Data, and GF Data, combined with income-approach analysis of the company's own earnings. Rules of thumb are acceptable only as reasonableness checks, never as the method itself.

Can a Minnesota estate deduct a family business from estate tax?

Partially, through the qualified small business property election on Schedule M706Q, which can add up to $2 million of deduction on top of Minnesota’s exclusion. Qualification is strict: gross annual sales of $10 million or less, no passive activity, and material participation, and a 16% recapture tax applies if heirs sell or stop qualified use within three years.
