Maine is an equitable distribution state, so a marital business interest is divided fairly rather than automatically 50/50, and Maine courts generally value marital assets as of the time of trial rather than the filing date. Does the Maine estate tax apply to a closely held business?

Yes, if the Maine taxable estate exceeds the exclusion amount, which was $6.41 million for deaths in 2024, with rates of 8% to 12% above it. The business interest enters the estate at fair market value, which is exactly what a defensible valuation establishes.
